Before Ms Miller’s case emerged into the public eye, we crowdfunded the case that eventually became the ‘People’s Challenge’. Alongside Ms Miller we successfully challenged the Government’s position that Article 50 could be triggered without Parliamentary authorisation.

Case overview
We argued that: – Parliament had given us rights as EU citizens; – Triggering Article 50 would, without more, lead to the removal of those rights; and – What Parliament had given to us, the Government could not take away.
The Supreme Court agreed (by a majority of 8-3): an Act of Parliament was needed to initiate the process that would lead to the removal of our rights as EU citizens.
The case is widely seen as being a significant development in the history of the UK’s constitution, setting one important limit on the power of the Government, and restating the sovereignty of Parliament.
