We’re challenging the BSB’s failure to act on trans harassment

The barristers’ regulator did nothing when Sarah Phillimore deadnamed and misgendered a trans woman online, so we’re launching an appeal

Good Law Project is taking the next step in our complaint against the barrister Sarah Phillimore, asking the Bar Standards Board (BSB) to refer its decision in this case to the Independent Reviewer.

For more than a year since March 2024, Phillimore attacked Kate* online, misgendering her, deadnaming her and using graphic language about her genitals.

In August we lodged a formal complaint with the BSB, arguing that Phillimore’s actions were “likely to diminish the trust and confidence” placed in her or the profession. But the regulator rejected our complaint suggesting that Phillimore hadn’t singled Kate out “for cruel treatment”.

We think the BSB has failed to hold Phillimore to the high standards expected of barristers and to consider if her behaviour amounted to bullying or conduct that was seriously offensive, indecent or obscene. If their decision stands, it would mean that barristers could attack people on social media without risking any sanction.

Phillimore has also threatened Good Law Project’s director, Jo Maugham, with a claim for defamation – a claim he would vigorously defend.

If the BSB refuses to refer the case to the Independent Reviewer, we expect to bring judicial review proceedings against it. 

The transphobia Kate has faced online has been enough to push her to the edge. It’s time for the regulator to make sure barristers treat everyone with dignity and respect.
